1. Acceptance of Terms

By using our application, you agree to these Terms and Conditions ("Terms"). If you do not agree, please do not use the application.

2. User Accounts

2.1 Registration

You must register for an account to use certain features. Registration requires providing accurate information, including a phone number for Firebase Authentication.

2.2 Account Security

You are responsible for maintaining your account security and all activities under your account. Notify us immediately of any unauthorized use.

3. User Content

3.1 Content Ownership

You retain ownership of any content you upload ("User Content"). By uploading, you grant Motoavir a worldwide, non-exclusive, royalty-free license to use, display, and modify User Content solely to operate and improve the application. This license does not allow us to sell your content.

3.2 Content Moderation

We may monitor and remove User Content that violates these Terms, our community guidelines, or is otherwise objectionable. Users can report abusive content via the in-app reporting feature.

3.3 Content Storage

User Content is stored on Digital Ocean servers in Bangalore, India. By using the app, you consent to this storage and processing.

4. Data Protection

4.1 Personal Data

We collect and process personal data according to our Privacy Policy, including phone numbers (for authentication) and User Content.

4.2 Analytics and Tracking

We use third-party analytics and advertising-attribution tools, including Amplitude, Google Analytics, and the Meta (Facebook) App Events SDK, to measure usage, improve services, and attribute installs from advertising campaigns. Data collected includes interaction data, device information, app performance, and standard app events (e.g. install, registration, key in-app actions). Where the platform supports it, you may opt out via your device's OS-level privacy settings or by managing ad preferences with the relevant provider.

4.3 Data Security and Retention

We implement reasonable security measures. Data is retained as long as needed to provide services. See our Privacy Policy for details.

5. Use of the Application

5.1 Permitted Use

You agree to use the app lawfully and not infringe the rights of others.

5.2 Prohibited Activities

• Post illegal, defamatory, obscene, or harmful content.
• Attempt unauthorized access or data scraping.
• Engage in fraudulent or malicious activity.

6. Third-Party Content and Links

The app may include content from automotive brands, events, or news providers. We are not responsible for accuracy or availability of third-party content. Links to external websites are provided for convenience only.

7. In-App Purchases and Subscriptions

If enabled, purchases will be processed via Apple / Google payment systems. Motoavir does not store payment information. Subscription terms, billing, and cancellation are handled through the respective platform.

8. Motorsport Features & Predictions

Motoavir provides motorsport content including race schedules, driver and team statistics, community predictions, and discussion forums. By using these features, you agree to the following:

• Prediction System: The Oracle Points prediction system is a free community engagement feature. You may predict race outcomes (winner, podium, fastest lap, safety car) before each race. Points are awarded based on prediction accuracy. Predictions are final once locked and cannot be modified after the race session begins.
• No Gambling or Monetary Value: Oracle Points are for entertainment purposes only. They have no monetary value, cannot be purchased, sold, exchanged, transferred, or redeemed for cash, prizes, or any goods or services. The prediction system does not constitute gambling, betting, or wagering of any kind.
• Analyst Tiers & Leaderboards: Your analyst tier (Rookie, Analyst, Sharp, Expert, Oracle) is calculated from your prediction accuracy and Oracle Points. Tier rankings and prediction records may be visible to other users. Motoavir reserves the right to reset points, modify tier thresholds, or adjust the scoring system at any time.
• Third-Party Data Accuracy: Race schedules, results, driver statistics, and team information are sourced from third-party data providers. Motoavir does not guarantee the accuracy, completeness, or timeliness of this data. Prediction scoring is based on official race results as received from our data sources; disputes over results or scoring are resolved at Motoavir's discretion.
• Discussion Content: Motorsport discussion threads (stat debates, prediction rooms, live race discussions) are subject to the same content moderation and community guidelines as all other user-generated content on the platform. Abusive, discriminatory, or off-topic content will be removed.
• Feature Availability: Motorsport features, including specific series coverage (Formula 1, MotoGP, WRC, etc.), may be added, modified, or discontinued at any time. Availability of predictions for specific races or series is not guaranteed.

9. Trip Recording, GPS & Performance Tracking

Motoavir lets you record trips, track sessions, and other riding or driving activity using GPS, motion sensors, and (where supported) data from paired hardware. These features carry real-world safety, legal, and accuracy considerations that you accept by using them.

• Do not operate the app while driving or riding. You agree to start, stop, and interact with trip recording, track sessions, leaderboards, and any other feature only when it is safe and legal to do so — for example, while stationary, when handed off to a passenger, or with a hands-free / mounted device used in a way that complies with local law. You are solely responsible for operating your vehicle safely and lawfully at all times. Motoavir is not a navigation, collision-avoidance, or driver-assistance system, and must not be relied on as one.
• Track days, closed courses, and competitive events: Track-session and timing features are intended for use on closed courses, authorized racing venues, private property where you are permitted to ride, or controlled events. You will not use these features to encourage, plan, time, or compete in illegal street racing, speed contests on public roads, or any activity that violates local traffic, vehicle, or noise laws. You are responsible for confirming that the venue, vehicle, equipment, and event are appropriate and lawful for the activity you intend to record.
• Assumption of risk: Riding, driving, track days, and competitive motorsport carry an inherent risk of injury, death, vehicle damage, and damage to property. You voluntarily assume all such risks. To the maximum extent permitted by law, Motoavir, its affiliates, officers, employees, and contractors are not liable for any accident, injury, death, traffic violation, legal penalty, vehicle damage, property damage, lost data, or other loss arising out of or related to your use of, or reliance on, trip recording, route guidance, track timing, performance metrics, leaderboards, or any related feature.
• Indemnity: You agree to defend, indemnify, and hold harmless Motoavir from any third-party claim, demand, or proceeding (including reasonable legal fees) arising from your use of trip recording or performance features, your conduct while using the app, or your breach of this section.
• Accuracy disclaimer: Locations, speeds, distances, lap times, lean angles, and other metrics are derived from consumer-grade GPS and sensor inputs and can be inaccurate, delayed, or missing — particularly in tunnels, dense urban areas, indoor spaces, poor weather, or with low device battery. Recorded values are not certified, official, or admissible as a sporting result, evidence in a legal proceeding, or proof of vehicle behaviour. You will not present them as such.
• Battery, mobile data & hardware: Active trip and track-session recording uses significant battery, storage, and (when uploading) mobile data. You are responsible for any associated costs and for the suitability and safe mounting of any device or hardware you use.
• Permitted to record: Where applicable law requires consent from passengers or third parties for recording location, audio, or images, you are responsible for obtaining that consent. You will not use Motoavir to track another person without lawful basis.

10. Leaderboards & Public Performance Data

• Opt-in publication: Trips, sessions, and performance metrics are private by default. Leaderboard participation and public visibility require an affirmative action by you — for example marking a trip public, joining a club leaderboard, or enabling community ranking in settings — and can be revoked at any time from the app.
• Fair play: You agree not to submit fabricated, simulated, manipulated, or otherwise inauthentic data; not to misrepresent the vehicle, class, venue, or conditions; and not to use external tools, modifications, or shared accounts to obtain a ranking. We may remove, recalculate, exclude, or reset entries and bans accounts where we reasonably believe these rules have been breached.
• No prize, no guarantee: Leaderboard position confers no monetary value, prize, sporting title, or contractual right. We may add, remove, redesign, recalibrate, freeze, or discontinue any leaderboard at any time. Rankings are provided for community engagement only.
• What is shown: A leaderboard entry typically displays your username, profile photo, rank, and the metric being ranked. By participating you consent to that information being shown to other users of the app and, where the leaderboard is exposed on a public surface, to the public.
• Removal: You can remove an entry by deleting the underlying trip or session, by changing its visibility, or by opting out of community ranking. Removal takes effect prospectively; cached, derived, or aggregated copies may persist briefly as described in the Privacy Policy.

11. Third-Party Login Services (Facebook, Google, Apple)

Motoavir supports sign-in via third-party identity providers, including Facebook Login. When you sign in via a third-party provider:

• You authorize the provider to share the profile fields you approve on its consent screen (typically name, email, profile photo) with Motoavir for the purpose of creating or accessing your account.
• Your continued ability to sign in depends on that provider's service. We are not responsible for outages, account suspensions, policy changes, or data losses by the provider.
• Disconnecting Motoavir from your third-party account (e.g. removing the app from your Facebook Business Integrations) does not delete your Motoavir account or content. To delete your Motoavir account, use the in-app account deletion option or contact [email protected].
• Use of third-party login is also governed by the provider's own terms and privacy policy.

12. Reporting Abuse / DMCA

Users can report abusive or infringing content via the in-app reporting feature or by contacting [email protected]. We will investigate and may remove content that violates copyright or community guidelines.

We may suspend or terminate accounts for violations of these Terms. User Content may be deleted upon termination.

15. Governing Law and Dispute Resolution

These Terms are governed by Indian law. Any disputes shall be resolved under the exclusive jurisdiction of courts in Bangalore, India. Users agree to attempt arbitration before legal action where applicable.

16. International Users

The app is currently targeted at users in India. Future international use may require compliance with local laws and regulations.

17. Changes to Terms

We may update these Terms. Significant changes will be posted in the app. Continued use constitutes acceptance of the updated Terms.
